Please read these Terms before using the Site. They are short by legal standards, and they matter: they set out what you can expect from us and what we ask of you.
1. About these terms
These Terms of Service (“Terms”) govern your use of the website at heysea.us and any related pages and forms (the “Site”). The Site is operated by CIRO Marine, LLC (“CIRO Marine”, “we”, “us”), the exclusive North American representative of HeySea Yachts. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
2. Using the Site
You may use the Site for your personal, non-commercial purposes in connection with your interest in HeySea yachts. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or bulk-downloading content, or using it for any unlawful purpose.
We may suspend or withdraw the Site, or any part of it, at any time without notice.
3. Information, specifications and pricing
The Site is provided for general information about HeySea models and the services of CIRO Marine. Nothing on the Site is an offer to sell, and no contract for the purchase of a yacht is formed through the Site.
Specifications, speeds, capacities, ranges and layout dimensions are preliminary and subject to change without notice during the custom construction process. They do not form part of any contract of sale unless explicitly stated in a signed agreement.
Prices shown as “from” are indicative starting prices in US dollars for a base specification. They exclude taxes, duties, delivery, commissioning, options and customization, and may change at any time. Final pricing is confirmed only in a written quotation.
Renders, photography and layouts may show optional equipment, alternative palettes or features that differ from the final vessel.
4. Design Studio and inquiries
Access to the Design Studio and to private viewings, sea trials and build slots is offered at our discretion and may depend on availability. Submitting a request does not guarantee access or reserve a vessel.
When you submit a form you confirm that the information you provide is accurate and that you are at least 18 years old.
5. Text messages
Program. If you tick the text-message box on a form, CIRO Marine will send you recurring text messages about HeySea yachts and your inquiry. These may include marketing and may be sent using automated technology. Consent is not a condition of any purchase.
Frequency and cost. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opting out and help. Reply STOP to any message to stop receiving texts; you will receive one message confirming this. Reply HELP for help, or contact inquire@heysea.us or +1 (954) 468 0277.
Privacy. Mobile numbers and text-message consent are handled under our Privacy Policy and are never sold or shared with third parties for their marketing.
6. Intellectual property
All content on the Site, including renders, photography, drawings, specifications, text, logos, the HeySea and CIRO Marine names and marks, and the design of the Site itself, is owned by or licensed to CIRO Marine, HeySea Yachts or our design partners and is protected by copyright, trademark and other laws.
You may view and print pages for your personal use. You may not otherwise copy, reproduce, distribute, modify, publish or create derivative works from any content without our prior written permission.
7. Third-party sites and services
The Site contains links to third-party websites, including ciromarine.com and social media platforms. We do not control and are not responsible for their content, availability or practices. Links are provided for convenience and do not imply endorsement.
8. Privacy
Our use of your personal information is described in our Privacy Policy, which forms part of these Terms.
9. Disclaimer of warranties
The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, about the Site or its content, including as to accuracy, completeness, fitness for a particular purpose or non-infringement, or that the Site will be uninterrupted, secure or error-free.
10. Limitation of liability
To the fullest extent permitted by law, CIRO Marine, HeySea Yachts and their respective officers, employees, agents and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of or inability to use the Site or your reliance on its content. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless CIRO Marine and HeySea Yachts from any claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Site or breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.
13. Changes to these terms
We may revise these Terms at any time by updating this page. The date at the top shows when they were last revised. Your continued use of the Site after a change means you accept the revised Terms.
